A commentary about Oded Golan’s trial on James ossuary
The best way for Golan’s attorney to acquit him would be to demand a comparative DNA test of the bones in James ossuary with the bones in the ossuary inscribed “Jesus son of Joseph” from the Talpiot tomb. Some argue that they come from the same burial cave.
Golan would probably have feared proving that the James ossuary comes from Talpiot in 1980. Because the James ossuary would then be covered by a 1979 Israeli law, that gives all archeological artifacts unearthed in Israel to the State.
Golan”s defense lawyer could still petition a court order for related DNA tests of the James ossuary bones (that Golan reportedly has) with the “Jesus son of Jospeh” remains. I reckon no individual could get approval for such analysis in Israel. But a good lawyer boosted by distinguished expert opinion could affect a judge that this would be relevant, material evidence for defense. Because it could confirm precisely what the ascribed complete James ossuary inscription says, if the test proves these are brothers.
The trial on this matter has ended , and the judge’s decision is now attended. Discharge in a criminal case in Israel only means the prosecution was unable to evince (forgery here) beyond reasonable doubt. Whether the judge would venture over that is anybody’s guess.
In any event, the optimal authentication of the James ossuary would be to analyze it for mitochondrial DNA and compare that to Jesus’ Talpiot bone box. But then obviously Golan would be apprehensive about that, because pegging the James ossuary with Talpiot would put it within the reach of the Antiquities Law, and he loses ownership of it. Still, wealthy people could change that, too. In the distant future, I hope this matter would corroborate Lincoln’s observation “You can fool all the people some of the time, and some of the people all the time, but you cannot fool all the people all the time.”
